Terms of Service

1. Introduction and Acceptance

Welcome to Mac Mini Vault. These Terms of Service (“Terms”) govern your access to and use of our colocation, dedicated server, and related data center services. By accessing or using our services, you agree to be bound by these Terms, including our Acceptable Use Policy and Privacy Policy (both incorporated herein by reference). If you do not agree, please do not use our services.

Mac Mini Vault is a brand of CyberLynk Network, Inc.

2. Modifications to Terms

Mac Mini Vault reserves the right to modify, alter, or update these Terms at any time. Changes are effective immediately upon posting on our website. Your continued use of our services after notice of any modifications constitutes acceptance of the revised Terms.

3. Description of Services

Mac Mini Vault provides secure data center services, including colocation, dedicated server hosting, and network infrastructure hosting. Our services are designed to offer reliable connectivity, high-availability, and physical security for your equipment.

4. User Responsibilities

  • Compliance: You agree to comply with all applicable laws and regulations, as well as Mac Mini Vault’s Acceptable Use Policy.
  • Data and Security: Customers are responsible for maintaining current backups of their equipment and data. Mac Mini Vault will assist with best practices but is not liable for data loss.
  • Proper Use: You must not use our services in any manner that could harm the network, disrupt other customers’ services, or breach any security protocols.

5. Payment, Billing, and Cancellation

  • Billing: Services are billed on a monthly, quarterly, semiannual, or annual basis, with fees due in advance.
  • Cancellation: You may cancel service in writing (via email or support ticket) at any time, provided your services are not currently included in a separate service contract. Pro-rated refunds for unused service periods of over one month will be issued upon request, subject to any non-refundable fees detailed in a separate service contract.
  • Hardware & Rent2Own: Specific provisions regarding hardware shipments, Rent2Own, or upgrade programs are governed by separate agreements. Early termination may result in forfeiture of certain fees as described in those agreements.

6. Service Levels

  • Availability: While Mac Mini Vault makes commercially reasonable efforts to ensure uninterrupted service, scheduled maintenance, emergency repairs, or unforeseen events may cause temporary outages.
  • Force Majeure: Mac Mini Vault is not liable for service interruptions caused by events beyond its reasonable control, including natural disasters, acts of government, cyber attacks, or other force majeure events.

7. Intellectual Property

All content, software, documentation, and other materials provided by Mac Mini Vault are protected by intellectual property laws. You are granted a limited, non-exclusive license to use such materials solely for the purpose of accessing and using our services in accordance with these Terms. Any unauthorized use, reproduction, or distribution is prohibited.

8. Links to Third-Party Websites

Our website and services may include links to third-party sites (“Linked Sites”). These links are provided solely for your convenience. Mac Mini Vault is not responsible for the content, privacy practices, or policies of these sites. Your use of any Linked Site is at your own risk, and you are encouraged to review each site’s terms and policies.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. MAC MINI VAULT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. While we strive to provide high-quality and uninterrupted services, Mac Mini Vault does not guarantee that the services will be error-free or available at all times.

10. Limitation of Liability

IN NO EVENT SHALL MAC MINI VAULT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MAC MINI VAULT’S TOTAL LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE FEES PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE INCIDENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mac Mini Vault, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of our services or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws principles. Any disputes arising from these Terms shall be exclusively resolved in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to the jurisdiction of such courts.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the practices outlined in our Privacy Policy.

14. Entire Agreement

These Terms, together with our Acceptable Use Policy, Privacy Policy, and any additional service-specific agreements, constitute the entire agreement between you and Mac Mini Vault regarding the use of our services. Any modifications or waivers must be in writing and signed by an authorized representative of Mac Mini Vault or CyberLynk Network, Inc.
